Pittsburgh Jury Returns $ 3.08 Million Tire Tread Defect Judgment Towards Kumho Tire USA | Related press

PITTSBURGH, Sep. 29, 2021 / PRNewswire / – An Allegheny County jury has passed a unanimous jury verdict of $ 3.08 million for a truck driver who sustained serious injuries as a result of a defective truck tire manufactured in Korea by Kumho Tire suffered a sudden profile failure that caused his fully loaded dump truck to crash and roll over.

Plaintiff Milford Stevens was hauling more than 72,000 pounds of sand when the tread of the left front Kumho Powerfleet 983 tire of the dump truck he was driving in September 2014, a Thomas Construction truck overturned on US 422 near Muddy Creek Township. Mr. Stevens suffered severe neurological and physical injuries, including fractures of the vertebrae, head and face.

During the two-week trial testimony, trial attorneys Wes Ball and Skip Lynch of Kaster, Lynch, Farrar & Ball presented evidence that the tire was incorrectly designed and should not have been placed on the market. Among other things, it was found that the tire’s belts did not contain an adequate AO package, which prevented premature failure of the tire due to oxidation problems.

“This truck was a ticking time bomb because manufacturers like Kumho Tire USA are driven by profit rather than safety,” said Ball. “Bad designs create dire problems. Companies like this shouldn’t be allowed to benefit from our trading system while they are safety disregard our citizens. “

In addition to attorneys from Kaster, Lynch, Farrar & Ball, Mr. Stevens was represented by Dan Sherry Jr. of Eisenberg, Rothweiler, Winkler, Eisenberg & Jeck based in Philadelphia.

The case is Milford E. Stevens v Good Tire Service Inc. et al., No. GD 15 13492, in the Court of Common Pleas in Allegheny County, Pennsylvania.
