HARRISBURG, PA (KDKA) – A federal judge on Tuesday ruled certain Allegheny County’s postal ballot papers were legitimately counted and dismissed claims made by a Republican challenger against Pennsylvania Senator Jim Brewster of McKeesport.
Last week the Republican-controlled Senate refused to seat Democrat Brewster.
The refusal of the Senate Republicans to allow Brewster to take the oath of office resulted in a noisy scene in the Senate with the temporary overthrow of Lt. Governor John Fetterman as chairman.
While President Pro Tempore, Pa. Senator Jake Corman, a Republican who announced a 14-11 vote to remove Fetterman from the chair, repeatedly shouted to Fetterman, “The chairman will not step down.”
Now a victory in federal court paves the way for Brewster’s swearing in.
“They made the merit of the case, and they decided in our favor. I hope the only thing left now is to find out logistically how we can carry out the swearing-in as quickly as possible, ”Brewster told KDKA’s political editor Jon Delano on Tuesday afternoon.

Corman admits his refusal to seat Brewster last week was controversial.

Corman: “No. We did the right thing. We wanted to do it right again, not quickly.”
Ziccarelli now says she wishes Brewster the best when he takes the oath of office.
